BACKGROUND

On March 23, 2017, a U.S. Probation Officer submitted a fax correspondence to the Chino Police Department requesting information on recent activity involving Robert Young. 

Pursuant to this request, the police department contacted Mr. Young’s probation officer by telephone. The probation officer requested the police department perform a search of Mr. Young’s residence in order to determine if he was in violation of his probationary terms. 

On April 4, 2017, in response to the probation officer’s request, Chino police officers conducted a search of Mr. Young at his residence. Officers gave proper knock and notice, were allowed into the home by claimant Sharlene Young, and exited the home approximately 20 minutes later without incident.

ISSUES/ANALYSIS

On April 10, 2017, Ms. Young submitted a complaint to the Chino Police Department alleging, in part, that the officers who conducted the search on April 4th did so illegally, were aggressive, and damaged her front door. 

Ms. Young also made a specific allegation of racial profiling by a Chino Police Officer while he conducted a traffic stop on Mr. Young on March 10, 2017.

The Chino Police Department conducted an investigation into Ms. Young's complaint which resulted in her allegations being unfounded and/or the officer(s) in question being exonerated.

Staff recommends that the claim be rejected and proper notification be sent to claimants.  Chino Municipal Code Section 3.70.070 provides that the City Council shall act on a claim in the manner provided in Government Code Section 912.4 and 912.6 within forty-five days after the claim has been presented.  If the City Council fails to act on any claim filed under this chapter, the claim will be deemed denied on the forty-fifth day after the claim was presented.
