BACKGROUND

On September 17, 2018, the Planning Commission conditionally approved Site Approval PL18-0033.  The project includes the construction of a 28,600 square-foot concrete tilt-up industrial building on a vacant 1.46-acre parcel in the Light Industrial Zoning District located at 15515 Dupont Avenue (Exhibit A). The conditions of approval require public improvements on and adjacent to the project site which include, but are not limited to the construction of sidewalks, commercial driveway approach, and storm drain appurtenances.

 

ISSUES/ANALYSIS

The existing easement on the project property was originally granted for drainage purposes prior to the existence of storm drain infrastructure in the area.  With the construction of storm drain facilities on and near the project property, the drainage easement no longer serves a purpose.  For this and liability reasons, it is in the best interest of the City to quitclaim the easement.

To guarantee the completion of public improvements, the developer has submitted a Public Improvement Agreement and the necessary bonds. The City Attorney has reviewed and approved the agreement and bonds.
